Successfully speeding up your divorce isn’t common, and it’s an especially hard thing to accomplish. In order to have an expedited divorce, you need to meet one of these qualifiers:

  • Military: You have recently enlisted in the military and facing deployment.
  • Immigration: You applied for a Visa before your divorce started, and you need a Judgment of Divorce in order to stay in the country.
  • Pregnancy: You are expecting a baby, and your husband is not the biological father.
  • Marriage: You want to get remarried, but your original papers have been delayed or denied.
  • Purchasing Property: You’re separated from your spouse and you want to buy property as a single (unmarried) person.

Requesting an Expedited Divorce

In order to receive an expedited divorce, your attorney must file a motion with the court and request that your case become a priority. As with any divorce or family law matter, expedited divorces are extremely fact specific. This means that the little details matter, and you must be thorough in your motion.
Before filing a motion, your attorney will go over the facts of your case with you. Together you will pick a qualifier, and afterwards, you must compile documents that support the reason why you should be granted an expedited divorce.
