You can begin the process of contested divorce by first filing a complaint, which needs to be served to your spouse so he or she knows when to show up to court. Your spouse also needs to respond to your complaint.

Once this step has been completed, you and your spouse each need to gather documents that include bank statements, tax returns, and proof of income so the court is aware of the financial situation. If you need a temporary court order, such as to get child custody or child support, your divorce lawyer should let the court know at this point.

You can still try negotiating with your spouse while preparing for court in case this does not work. If a trial is necessary, the judge will first ensure that the discovery process is complete and all paperwork has been submitted. If so, he or she will let you and your lawyer know that you can go to trial.
