Attorney Brian Perskin explains the differences between an uncontested divorce and a contested divorce.
There is big difference between an uncontested divorce and a contested divorce. In an uncontested divorce, generally all the issues are settled. Generally in a simple uncontested divorce case, child support is resolved either by a family court order or by a stipulation of settlement. In an uncontested divorce both parties agree to actually get divorced. In an uncontested divorce, generally there is no property to distribute.
In a contested divorce the husband and wife generally don't agree on how to divide up the property, who should remain in the marital home and where the kids should live and where the kids should go to school and where the kids should go to summer camp. In a contested divorce some people even fight over the actual grounds for the divorce.
