Big changes have occurred in regard to New York divorce laws. Married couples can now file for divorce on a "no-fault" basis, something that was not allowed prior to October 14th, 2010. Instead of specifying grounds for divorce such as adultery, abandonment or imprisonment, or living separate for at least 1 year, either spouse can file for divorce based upon an oath that the relationship with their spouse has been irretrievably broken for at least 6 months. Instead of waiting a year while living under a separation agreement or falsely attesting to other grounds for divorce, married couples who have grown apart can file for divorce under this new option.
